Please read these Terms of Use carefully before using Brainary's website, creating an account, or enrolling in a programme.
1. Acceptance of terms
These Terms of Use ("Terms") govern your access to and use of brainaryhq.com, the Brainary learning platform, and any programmes, content, or services we provide (collectively, the "Services"). By creating an account, signing in, browsing our website, or enrolling in a programme, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
2. About Brainary
Brainary provides live, cohort-based online bootcamps and related educational services in data, analytics, finance, healthcare data, AI engineering, and related fields. Programmes are delivered through our platform and may include live classes, recorded sessions, homework, grading, schedules, resources, forums, and an AI tutor ("Luna"). We may update programme content, schedules, instructors, or platform features to maintain quality. We will notify enrolled students of material changes that affect their cohort.
3. Eligibility
You must be at least 16 years old to use the Services. If you are under 18, you confirm that you have permission from a parent or legal guardian. You must provide accurate, current information when registering and keep your account details up to date. Brainary reserves the right to refuse or cancel access where information is false, misleading, or incomplete.
4. Account registration and security
You may register with email and password or, where available, sign in with Google. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at team@brainaryhq.com if you suspect unauthorised access. Sharing your account credentials with others is prohibited and may result in suspension. Instructor accounts require a valid instructor access code. Misrepresenting your role to gain elevated access is a violation of these Terms.
5. Enrolment, access, and payment
Enrolment in a paid programme is confirmed upon successful payment unless otherwise agreed in writing. Fees, instalment options, and currency are displayed at checkout. Payments are processed securely by Stripe. By completing checkout, you authorise us and Stripe to charge the payment method you provide for the stated fees. Programme access is personal to you and tied to your enrolled cohort. Access periods, start dates, and cohort schedules are described on the relevant programme page or at enrolment. Failure to pay instalments, where applicable, may result in suspension of access until payment is resolved. We may offer scholarships, discounts, or promotional pricing. Unless stated otherwise, promotional terms cannot be combined and apply only to the specified offer.
6. Refund policy
New enrolments may be eligible for a full refund within 7 days of purchase, provided no more than one live session has been attended. Refund requests must be submitted in writing to team@brainaryhq.com and include your account email and programme name. Approved refunds are processed to the original payment method where possible. After the 7-day window, or once more than one live session has been attended, fees are generally non-refundable except where required by applicable consumer protection law or where we agree otherwise in writing.
7. Live sessions and third-party tools
Live classes may be delivered via third-party video conferencing tools such as Zoom or Google Meet. Links to sessions are provided through the platform. You are responsible for having a suitable internet connection and equipment. Session recordings, where provided, are for enrolled students' personal learning only and may not be copied, redistributed, or published without written permission. Use of third-party tools is also subject to those providers' own terms and privacy policies. Brainary is not responsible for outages or issues caused by third-party services outside our reasonable control.
8. Platform features
Depending on your enrolment, the platform may include: • Cohort classroom — curriculum, class schedules, resources, and classwork • Homework and assignments — submission, feedback, and grading • Forum — community discussion within your learning environment • Notifications — email and in-app alerts about classes, deadlines, and account activity • Calendar exports — iCal feeds for your cohort schedule • AI tutor (Luna) — AI-assisted learning support Feature availability may vary by programme, cohort, and role (student, instructor, or administrator). We do not guarantee uninterrupted access and may perform maintenance with reasonable notice where practicable.
9. User content and submissions
You may submit content through the platform, including forum posts, homework, assignment files, and links (such as Google Drive URLs). You retain ownership of content you submit, but grant Brainary a non-exclusive, worldwide licence to use, store, display, and process that content as needed to operate the Services, deliver your programme, and provide feedback or grading. You are responsible for your submissions. Do not upload content that infringes others' intellectual property, contains malware, or includes personal data of third parties without lawful basis. Instructors and administrators may view submissions and forum activity within cohorts they manage, as necessary to deliver and assess the programme.
10. Intellectual property
All course materials, videos, documents, curricula, branding, software, and other platform content are owned by Brainary or its licensors and are protected by copyright and other intellectual property laws. You may access and use materials solely for your personal, non-commercial learning while enrolled. You may not copy, redistribute, resell, publicly share, screen-record for distribution, or create derivative works from course content without prior written consent from Brainary. The Brainary name, logo, and related marks may not be used without permission.
11. AI tutor disclaimer
The AI tutor (Luna) provides educational assistance only. Responses may be incomplete, outdated, or incorrect. Luna does not provide professional, legal, financial, medical, or employment advice. Do not rely on AI-generated output for decisions that require qualified professional judgment. You are responsible for verifying important information and for not submitting sensitive personal data in AI chat sessions. Use of the AI tutor is subject to reasonable usage limits and our acceptable use standards.
12. Code of conduct
Students, instructors, and other users must participate respectfully. You agree not to: • Harass, bully, discriminate against, or intimidate others • Share login credentials or attempt to access accounts or data you are not authorised to view • Post spam, misleading content, or malicious files • Disrupt live sessions, forums, or platform operations • Attempt to scrape, reverse engineer, or circumvent platform security or access controls • Use the Services for any unlawful purpose Violations may result in content removal, suspension, or termination of access without refund, at our discretion.
13. Disclaimers
Brainary provides educational services and career support resources. We do not guarantee employment, salary outcomes, certification by third parties, or specific career results. The Services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.
14. Limitation of liability
To the fullest extent permitted by applicable law, Brainary and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid to Brainary for the relevant programme in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
15. Suspension and termination
We may suspend or terminate your account or access to the Services if you breach these Terms, fail to pay applicable fees, or if continued access would harm other users or the platform. You may close your account at any time by contacting team@brainaryhq.com. Upon termination, your right to access enrolled content may end, subject to any retention periods described in our Privacy Policy. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will remain in effect.
16. Governing law
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection rules in your country of residence require otherwise.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to registered users by email or through the platform. The "Last updated" date at the top of this page reflects the latest version. Continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms.
